In February 2022, former Miami Dolphins head coach (now Minnesota Vikings defensive coordinator) Brian Flores filed a class-action lawsuit against the NFL and several teams, including the New York Giants, alleging systemic racial discrimination in hiring practices.

Flores specifically accused the Giants of conducting a “sham” interview for their head coaching position in January 2022, claiming the team had already decided to hire Brian Daboll and only interviewed him to comply with the Rooney Rule, which mandates considering minority candidates.

The Giants denied the allegations, stating they interviewed a diverse group of candidates and that Flores remained a serious contender until the final decision. Early court rulings kept the lawsuit active.

In August 2025, the 2nd U.S. Circuit Court of Appeals ruled that Flores’ claims against the Giants, Denver Broncos, and Houston Texans could proceed in court, invalidating the NFL’s arbitration clause. The court deemed the process — overseen by Commissioner Roger Goodell — biased and unenforceable under the Federal Arbitration Act.

Nearly four years later, the NFL has petitioned the U.S. Supreme Court to review whether its arbitration agreement, designating the commissioner as arbitrator, is valid. The league argues for internal resolution of disputes, while critics highlight inherent conflicts of interest.

The case remains pending, with potential implications for employment disputes in professional sports.
